Terms and Conditions for Tribute Media Tape Transfer Service

By using the tape transfer services provided by Tribute Media ("we," "us," or "our") on www.tributemedia.nz (the "Website"), you agree to the following Terms and Conditions.
1. Service Overview
Tribute Media offers tape and media transfer services, which include converting media from various analog formats (such as VHS, VHSC, DigiBeta, Betamax, MiniDV, 8mil, Audio Cassettes, etc.) to digital formats (such as DVD, USB, or online files)
2. Customer Obligations
You are responsible for ensuring that the materials you provide for transfer are legally owned by you and do not infringe on the copyright or intellectual property rights of others. By sending us any media, you warrant that:
You are the legal owner or have permission to use the media.
The media does not contain any illegal or offensive content.
3. USB Policy
If you are providing your own USB for digital delivery, it must be new and unused. This is to protect our systems from potential malware or data corruption and to ensure that the latest speed and technology standards are met for optimal transfer quality.
We reserve the right to reject any used or outdated USB drives.
Alternatively, you can purchase a new USB from Tribute Media at an additional cost.
4. Backup Policy
As part of our service, we will retain a backup copy of your converted media for 30 days after the completion of the transfer process. This backup is kept to protect your investment in case of any issues with your received media during that time.
After 30 days, the backup will be permanently deleted without notice. We strongly recommend that you create your own backup copies of the digital files as soon as you receive them.
Tribute Media is not responsible for any data loss after the 30-day backup period has expired.
5. Pricing and Payment
Full payment is required before collection or return courier of completed jobs.
Payment must be made once you have been notified that your transfer is complete and ready for collection or shipment.
\We will not release or ship any completed media until full payment is received.
6. Shipping and Handling
Customers are responsible for safely packaging and shipping media to our facility. We recommend using a trackable shipping method.
Tribute Media is not responsible for any damage, loss, or delay that occurs during shipping to or from our facility.
After the transfer process is complete, we will return the original media along with the digital files, either for collection or via courier, as per your preference.
7. Turnaround Time
Standard turnaround time for our services is approximately [2 weeks] from the time we receive your media. This may vary depending on the volume of orders and media format.
We will do our best to meet any requested deadlines but do not guarantee completion within a specific time frame unless prior arrangements are made.
8. Media Quality
Due to the age and condition of some media, we cannot guarantee perfect transfer quality. Our team will attempt to restore the best possible quality from your provided materials.
We are not responsible for any issues resulting from pre-existing damage or deterioration of the media.
9. Liability and Limitations
Due to the age and condition of certain tapes, there is a risk of breakage during the transfer process. While we take every precaution to prevent this, we cannot guarantee that old or deteriorating tapes will not break or suffer further damage during handling.
Under no circumstances shall Tribute Media be liable for any indirect, incidental, or consequential damages, including lost profits or data.
10. Digital Storage and Delivery
We offer digital delivery via USB, DVD, or cloud services. Customers must specify their preferred delivery method when placing the order otherwise it will be assumed that USB is the preferred delivery method.
Tribute Media will not store or archive your digital files beyond the 30-day backup period as outlined in our Backup Policy. It is your responsibility to ensure your media is backed up once delivered.
11. Copyright and Intellectual Property
All media sent for transfer must comply with New Zealand’s copyright laws. Tribute Media does not transfer copyrighted material without proper authorization.
By submitting media for transfer, you confirm that you have the right to duplicate and convert the material. Tribute Media assumes no responsibility for illegal or unauthorized transfers.

We value your privacy and are committed to protecting your personal information. This Privacy Policy outlines how we collect, use, and protect your data when you use our services.

13. Cancellations and Refunds
Orders may be canceled within 24 hours of placement, provided that the transfer process has not begun. Once work has commenced, cancellations will not be accepted.
Refunds for unsatisfactory services will be assessed on a case-by-case basis. Please contact us within 7 days of receiving your completed transfer if you have any concerns.
14. Amendments to Terms
We reserve the right to modify or update these Terms and Conditions and Privacy Policy at any time. Any changes will be posted on this page, and your continued use of our services constitutes acceptance of the updated terms.
15. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these Terms and Conditions or your use of our services will be subject to the exclusive jurisdiction of the New Zealand courts.
